Terms of Service.

The rules of the road. What you can expect from us and what we expect from your institution.

1. Acceptance of Terms

By accessing or using Taifa Mail, operated by RCFI ("we", "us") as part of the GovConnect Kenya organisation, including govconnect.ke and any associated applications, you agree to be bound by these terms. If you do not agree, do not use our services.

2. Description of Services

Taifa Mail is an email delivery platform for Kenyan government ministries, counties, agencies, and public institutions. The service includes:

  • Email API and SMTP relay: transactional and broadcast email delivery.
  • Domain management: DKIM, SPF, and DMARC verification and monitoring.
  • Analytics: delivery, open, click, bounce, and complaint tracking.
  • Audience tools: contact lists, templates, and suppression management.

3. Accounts

Workspace access requires first-party authentication (email and password, magic link, or passkey). By signing in, you confirm that:

  • You are an authorised officer of the institution whose workspace you access.
  • The information associated with your account is accurate.
  • You are responsible for all activity under your account.

We reserve the right to suspend or terminate accounts that violate these terms.

4. Acceptable Use

You agree not to:

  • Use our services for any unlawful purpose.
  • Send spam, phishing, or malicious content through our platform.
  • Send email to recipients who have not consented to receive it.
  • Attempt to gain unauthorized access to our systems or other users' accounts.
  • Interfere with or disrupt our services or infrastructure.
  • Reverse engineer, decompile, or otherwise attempt to extract source code.
  • Use our services to compete with Taifa Mail without written permission.

5. Intellectual Property

The Taifa Mail platform, branding, code, and content are the property of RCFI. You may not copy, modify, distribute, or create derivative works based on our products without written permission.

Content you create using our services (emails, templates, contact lists, etc.) remains your property. By using our services, you grant us a limited license to store and process this content as needed to provide the service.

6. Access and allocation

Taifa Mail is provided free of charge for authorised Kenyan government institutions. There is no subscription billing for standard institutional use. Access to hosted mailboxes is governed by ICTA allocation: your institution requests capacity with an Authorizing Officer letter, and ICTA approves mailbox allowance and domain hosting.

We may adjust operational limits (for example send volume or storage) for platform stability and fair use. Material changes to access policy will be communicated to registered institutions with reasonable notice.

7. Data and Privacy

Your use of our services is also governed by our Privacy Policy. By using our services, you consent to the collection and use of information as described in that policy.

8. Service Availability

We aim to maintain high availability for all services but do not guarantee uninterrupted access. We may perform maintenance, updates, or modifications that temporarily affect service availability. We will provide reasonable notice for planned downtime where possible.

9. Limitation of Liability

To the maximum extent permitted by law, RCFI shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services, including loss of data, revenue, or business opportunities.

Our total liability for any claim shall not exceed a reasonable cap appropriate to a free public-sector service, as set out by applicable law and any governing agreement with ICTA or your institution.

10. Termination

Either party may terminate the relationship at any time. You may stop using our services and request account deletion. We may suspend or terminate your access if you violate these terms.

Upon termination, we will retain your data for 30 days to allow for export, after which it will be permanently deleted.

11. Governing Law

These terms are governed by the laws of the Republic of Kenya. Any disputes shall be resolved in the courts of Nairobi, Kenya.

12. Changes to These Terms

We may update these terms from time to time. Continued use of our services after changes constitutes acceptance of the updated terms. We will notify users of significant changes via email.
